Encroachment
Encroachment Permits
The Encroachment Permits section of Development Services processes and issues permits for construction activities in all County rights-of-ways. Encroachments include but are not limited to special events, driveways, structures, facilities, construction, improvement, maintenance, utilities projects that involve excavation or trenching; street improvement projects; and tree trimming, removal, planting and/or landscaping within the County right-of-way and objects of any kind placed in, on, under, or over any County highway.
"County highway" means and includes all or any part of the entire width of right-of-way of any road, street, land, alley, way, place, or cul-de-sac maintained by the County and open to the use of the public for purposes of travel, whether or not such entire width is actually used for highway purposes, and whether or not it has been accepted into the County Road system by resolution of the County Board of Supervisors. It also includes bridges, culverts, curbs, drains, ditches, and all works incidental to County highway.
Special Events includes, but is not limited to, activities such as parades, marathons, bicycle events, walkathons, marches, triathalons, festivals, farmer's markets, block parties, civic, and celebration activities. Construction and maintenance activities are not deemed special events.

- Conducts plan review on construction permits

- Conducts engineering plan review for minor and major subdivision projects involving drainage, new or re-construction of drive approaches, and improvements on County right-of-way
- Oversees any issues that arises within the County right-of-way such as illegal signs, refuse, sediments, erosion, etc., and interface with the general public and other departments and agencies related to these issues.

Encroachment Permit Conditions and Resources
Please Read Each Section Carefully
The Following conditions shall be considered as a part of the Encroachment Permit.
All permit work shall conform to the current Standard Specifications of the Department of Public Works of the State of California.
The permittee’s copy of this permit must be kept on the work site at all times work is in progress an shall be exhibited upon demand by representatives of the Road Department, Fire Department, Police Department and Highway Patrol.
The permittee shall give not less than forty-eight (48) hours notice of intent to work, exclusive of Saturdays, Sundays or holidays.
Traffic signs and contractor warning devices shall be in accordance with the “Manual of Warning Signs, Lights and Devices for Use in Performance of Work Upon Highways” issued by the State of California, Business and Transportation Agency, Department of Public Works.
- The permittee (fire district) will be responsible for the installation and maintenance of the dots.
- Dots will be permitted on streets and roads which have been improved to Subdivision standards (concrete curbs and gutters or concrete v-gutters).
- No dots will be permitted on roads with pavement width less than 20 feet.
- Roads with pavement width of 20 ft. or wider but without concrete curb and gutter will be considered on a case-by-case basis. In general dots would be permitted onthese roads where a potential visibility problem due to parked cars, trees, etc. exists.
- Dots will be located from six to twelve inches on fire plug side of centerline (or lane lineof four lane roads).
- Fire districts should be encouraged to assist their fire fighters in locating plugs bykeeping brush away from the plugs, keeping the plugs adequately painted and providingthe fire fighters with proper maps.
State Guidelines For Use of Blue Reflective Pavement Markers As Amended October 26, 1983
The use of blue retro reflective pavement markers should be reserved as a method and means of identifying fire hydrant and water supply locations for fire fighting purposes. Blue markers used for other purposes which could be confused with the above purpose should be removed. This statement does not mandate their use; however, when used, blue marker installations should conform to the following recommendations. The fire district/department should seek agreement/approval from the authority having jurisdiction over the roadway before installations are made. Permits may be required.
Recommended Installations
A.Two-Way Streets or Roads - On striped roads markers should be placed six inches from edge of painted centerline on the side nearest the fire hydrant. On unstriped streets or roads, if the width is 20” or wider the marker should be placed six inches from the approximate center of the roadway on the side nearest the hydrant. On unstriped streets or roads less than 20” in width the marker shall be placed on the approximate center of the roadway.

B. Streets with Left Turn Lane at Intersection – Markers should be placed six inches from edge of painted white channelizing line on the side nearest the fire hydrant.
C. Streets with Continuous Two-Way Left Turn Lane – Markers should be placed six inches from the edge of the painted yellow barrier line on the side nearest the fire hydrant.
D. Freeways and Expressways – Because of higher maintenance at these locations if placed on the roadway, markers should be placed on shoulder one foot to the right of the painted edge line opposite the off-right-of-way fire hydrant location.
The following conditions shall be considered as part of the Encroachment Permit.
All permit work shall conform to the current Special Provisions for Encroachment Work and Standard Specifications of the Department of Transportation of the State of California.
A copy of the permit must be kept at the work site at all times and shall be exhibited upon the demand of any representative of the Public Works Department, Housing and Community Development, the Fire Department, Police Department, or California Highway Patrol.
The Permittee shall give not less than forty-eight (48) hour notice of intent to work, exclusive of Saturdays, Sundays, and Holidays. For more information call (831) 755-5025.
Note: No Permit Shall Be Construed As Authority To Close A Road
Existing drainage shall be undisturbed or improved.
Surplus materials shall be removed and disposed of and the work site left in a neat and professional manner.
All Encroachment work must be adequately posted, signed, barricaded, and lighted by the Permittee.
Traffic signs and contractor warning devices shall be in accordance with the “Manual of Warning Signs, Lights and Devices for Use in Performance of Work Upon Highways,” issued by the State of California, Department of Transportation.
Any contractor who plans to construct a trench or excavation five feet (5’) or deeper shall comply with Labor Code 6424, relating to the State Permits.

- All pertinent sections of County Code Title 14 shall apply.
- Applicant shall furnish proper traffic control signs with black letters 6” high on orange background, one to face each direction of traffic.
- Notify California Highway Patrol (area commander), County of Monterey Sheriff’s Office, Fire Department and Ambulance Service at least one week before event is to be conducted.
- Traffic handling requirements will be determined and coordinated with the California Highway Patrol no later than one week prior to event date.
- Interference with or direction of traffic shall be under the supervision of the California Highway Patrol.
- Traffic signs and warning devices shall be in accordance with the current California Manual on Uniform Traffic Control Devices (CA MUTCD) issued by the State of California, Department of Transportation.
- At the conclusion of the event, a thorough review of the route, assembly and disassembly areas shall be made, and all litter shall be picked up and properly disposed of.
- By accepting this permit, your organization shall assume full responsibility for all claims that may arise as a direct or indirect result of this activity. It is your responsibility to defend and hold harmless the County of Monterey, its agencies, officers and employees in any claims brought against them as a result of this activity.
Encroachments Condition
The following conditions shall be considered as apart of this Encroachment Permit.
- All pertinent sections of the Monterey County Code Title 14 shall apply.
- A copy of your Encroachment permit shall be kept on the work site at all times while work is in progress and shall be exhibited upon demand by representatives of the Department of Public Works, Housing and Community Development, Sheriff’s Department, and/or the California Highway Patrol (CHP).
- Permittee shall notify the County of Monterey Housing and Community Development at least 48 hours exclusive of Saturday, Sunday and holidays, prior to commencing or resuming any work. Once work has begun, the permittee shall diligently pursue the work in such a way as to cause the least interference and inconvenience to the public.
- All work and materials used in County road restoration shall conform to the Standard Specifications of the Department of Public Works and the current State of California Standard Specifications.
- All existing roadside ditches and drainage facilities shall be promptly restored to original condition or better and proper drainage maintained during the course of construction.
- Attention is directed to Section 7-1.03, "Public Convenience", 7-1.04, "Public Safety", and Section 12, "Temporary Traffic Control" of the latest Caltrans Standard Specifications. Nothing in these conditions shall be construed as relieving the permittee or contractor from their responsibility as provided in said section 7-1.04 of the latest Caltrans Standard Specification.
- Permittee shall provide all signs, lights, barricades, barrier rail, and/or other temporary traffic control devices, including fences and competent flag persons as may be required to adequately warn, guide and protect the travelling public. All construction signage shall be per the current CA MUTCD - California Manual for Traffic Control Devices. Warning Signs, Lights and Devices for use in performance of work upon highways, shall be diligently maintained at all times including non-working hours, weekends and holidays.
- Traffic may be reduced to one 12' lane when properly signed, coned, and properly equipped flag persons are posted at both ends of restricted area to assist in the safe flow of traffic. Road shall be restored to 2 - 12' (Minimum) unrestricted traffic lanes for dark or non-working hours.
- County roads may be closed to through traffic provided approval by the Director of Public Works in lieu of the Board of Supervisors approval for such closure is obtained. The request shall outline, in writing, all traffic control measures and alternate routes. Allow at least ten (10) working days for obtaining approval.
- The Director of Public Works or their designee shall be the sole judge as to the adequacy of the finished pavement within the area of responsibility of the County of Monterey.
- The Department reserves the right to require tests at locations and depths designated during performance of the work. All material testing shall be at the permittee's expense. The County of Monterey shall be the sole judge as to the adequacy of all tests and test results and shall receive a copy of all test results within ten (10) working days after testing. The County reserves the right to require Certificates of Compliance and other test reports.
- If applicable, permittee shall comply with all Environmental requirements including CEQA and other applicable permits for the required work.
- Upon completion of the work, the disturbed portion of the roadway shall be finished in accordance with Section 22 of the Standard Specifications - State of California. Surplus material shall be removed and disposed of and the streets restored to a safe, neat, and acceptable condition. Grass, ice plant and shrubbery in areas supporting such vegetation disturbed by this work shall be replaced and restored.
- Environmental stewardship including dust control shall be in accordance with Section 14 of the latest Standard Specifications.
- The permittee shall indemnify and hold harmless the County of Monterey and all officers, employees and volunteers thereof, from all claims, suits, or actions of any name, kind, and description brought forth and resulting directly or indirectly from the installation of the Encroachment permit facilities.

The following conditions shall be a part of the Encroachment Permit.
- This permit is authorization for use within the public road right-of-way for parking vehicles, the temporary laying of cable and test recording equipment only.
- No testing shall be conducted within the paved portion of the roadway or near any drainage, or other structure or facility.
- All indentations and excavations shall be backfilled and compacted. No excavation shall be made unless approved by this Department prior to commencing work.
- The road right-of-way shall be left in a neat, presentable condition.
- The permittee shall indemnify and hold harmless the County of Monterey, and all officers and employees thereof, from all suits, claims or legal actions of every name, kind and description brought forth as a result either directly or indirectly, of the work performed under this permit.
- This permit is issued for work within the County road right-of-way only and does not imply trespass, encroachment, etc. onto privately owned property.
- Under no circumstances shall this work interfere with public traffic or present a public safety problem. Proper signs and other devices pertaining to public safety shall be used at all times.
- In lieu of fastening cable down with duct tape, the cable shall be taped to a ½” minimum nylon rope stretched taut across the roadway and the ends of the ropesecurely anchored on both side of the pavement clear of traffic. A BARRICADE SHALL BE PLACED OVER ANCHOR STAKE PLACED IN SHOULDER OF ROAD.
The following conditions shall be considered as a part of the Encroachment Permit.
All permit work shall conform to County of Monterey Department of Public Works standard plans and details and the current Caltrans standard plans and specifications.
A copy of your permit must be kept on the work site at all times and shall be exhibited upon demand by representatives of Public Works, the Fire Department, Police Department, Housing and Community Development, and the California Highway Patrol.

Existing drainage shall be undisturbed or improved.
It is the intent of the Ordinance that the trench within the roadway be opened, backfilled, paved and completed in the same day, or otherwise securely plated properly as project dictates or approved by the Department of Public Works.
Trench Backfill shall consist of:
- Structure Backfill, minimum thickness 22” (R-60, SE-25, RC-95%).
- Class 2 A.B., minimum thickness 6” (R-78, SE-27, RC-95%).
- Type B, A.C., minimum thickness 3” or match existing whichever is greater.
In addition to asphalt paving, on chip seal finish roads, a medium type chip seal shall be required and shall be applied in accordance with Section 37 of the Standard Specifications.
Any work area opened for public use, either temporary or permanent, shall be maintained true and even with the adjacent pavement, and kept dust free.
Surplus materials shall be removed and disposed of and the work site left in a neat and professional manner.
All Encroachment work must be adequately posted, signed, barricaded and lighted by the permittee.

- Every person affiliated with this event shall use the portable lavatories provided for the event.
- At the conclusion of the parade, race, or bicycle rides, a thorough review of the route, assembly and disassembly areas shall be made, and all litter shall be picked up and properly disposed of.
- Permittee shall be responsible for removing all installed signs and markings on the road routes at the end of the event.
- By accepting the permit, your organization shall assume full responsibility for all claims that may arise as a direct or indirect result of this activity. It is your responsibility to defend and hold harmless the County of Monterey, its agencies, officers and employees in any claims brought against them as a result of this activity.

Property Line, determined by dedication, shall control the grade of the drive approach. Structural Section shall consist of:
- Class 2 Aggregate Base (A.B), minimum thickness 6” (R-60, SE-25, RC-95%)
- Type B Asphalt Concrete (A.C.), minimum thickness 3” or match existing whichever is greater.
Concrete cement or concrete pavers maybe allowed on County right-of-way (R.O.W.) provided they shall be constructed six feet (6’) from the edge of pavement (E.P.) or three feet (3’) from the flowline (F.L.) whichever is greater from the Edge of Pavement (E.P.). It is the sole responsibility of the property owner to remove or replace the concrete structure if needed at their own expense.
Acceptance of Encroachment Permit work is subject to completion of dedication requirements, imposed by (Use, Special, Variance, and Minor Subdivision).
Surplus materials shall be removed and disposed of and the work site left in a neat and professional manner.
All Encroachment work must be adequately posted, signed, barricaded and lighted by the permittee.
Traffic signs and contractor warning devices shall be in accordance with the “Manual of Warning Signs, Lights and Devices for Use in Performance of Work upon Highways” issued by the State of California, Business and Transportation Agency, Department of Public Works.

SUPPLEMENT TO FORM RF:
No Permit Shall Be Construed As Authority To Close A Road.
Failure to comply will result in a Stop Work Order and may result in suspension/loss of permit and applicant will be subject to any applicable fines and penalties.
The following conditions become a part of the Encroachment Permit:
- A copy of the permit must be kept at the work site at all times while work is in progress and shall be exhibited upon demand by representatives of the County of Monterey Housing and Community Development (HCD), Sheriff’s Department and/or California Highway Patrol (CHP).
- Permittee shall notify the HCD at (831) 755-5025 forty-eight (48) hours, exclusive of Saturday, Sunday and Holidays, prior to commencing or resuming any work.
- Prior to commencing any work, the permittee shall designate in writing, an authorized representative and telephone number, who shall have the authority to represent and act in the permittee’s behalf. Also, the name and telephone of an individual with the authority and appropriate skills to perform emergency work in regard to public safety and/or public convenience at any hour including weekends, holidays and during periods of work permit suspensions or cancellations. Once work has begun, the permittee shall diligently pursue the work in such a manner as to cause the least interference and inconvenience to the public.
- When any trench is five feet (5’) or more in depth, the permittee shall obtain a “Permit to Excavate” (except as modified in subsequent paragraphs), from the Division of Industrial Safety, Department of Industrial Relations, State of California, at (510) 794-2521 or visit their website at www.dir.ca.gov. Public Utility Companies and U.S. government agencies are not required to obtain such permit.
- Pipe and jointing materials shall be at the site prior to trenching within the road right-of-way.
- Trenches shall be located further from roadway structures, curbs, gutters and sidewalks, etc., than a distance equal to the depth of the trench or six (6) feet from face of curb except as shown otherwise on the approved plans. All road structures, pavement, curbs, gutters, sidewalks, etc., that are undermined or disturbed during construction shall be removed, the ground recompacted, and a new structure installed in accordance with County of Monterey standard details and specifications, at the permittee’s expense.
- A T-trench shall be required on all paved road on traveled way with a minimum of twelve (12”) inches (typ) on both sides except on shoulder area.
- All existing roadside ditches and drainage facilities shall be promptly restored to original existing condition and proper drainage maintained during construction.
- Permittee shall provide all signs, lights, barricades, barrier rail, and/or traffic control facilities, including fences, and competent flag persons as may be required to adequately warn, guide and protect the public. All signage shall meet the requirements of the State of California’s “Manual of Warning Signs, Lights and Devices for Use in Performance of Work upon Highways,” current edition, and shall be diligently maintained at all times, including non-working hours, weekends and holidays. Reference is made to the Standard Specifications, State of California, Section 7.
- With the approval of the HCD, traffic may be reduced to a twelve (12’) foot lane when properly signed, coned, and properly equipped flagmen are posted at both ends of the restricted area to assist in the safe flow of traffic. Roads shall be restored to two (2), twelve (12’) foot (minimum) unrestricted traffic lanes for dark of non-working hours.
- County of Monterey roads may be closed to thru traffic provided written approval is obtained from the Monterey County Road Commissioner for such closure. The request shall outline, in writing, all traffic control measures and alternate routes. Allow not less than ten (10) working days for obtaining approval.
- In the event the permittee or permittee’s contractor fails to satisfactorily comply with the requirements of Paragraph (i) and /or fails to maintain trenches in a safe, smooth condition as required in Paragraph (h), the County of Monterey may place the necessary signs and/or perform the trench repair and other maintenance work to ensure public safety and convenience, and will collect all costs incurred from the permittee. Such failure to comply with the terms of this permit shall be considered cause for suspending and/or cancelling this permit.
- Excavations for jacking and boring devices shall not be located nearer to the edge of pavement, paved shoulder or concrete curb than a distance equal to the depth of bore/jacking pit or day lighting pit. In no case shall the pit be nearer than five (5’) feet to the edge of pavement or surfaced shoulder.
- Relative compaction within the County of Monterey roadway (“roadway” as defined in the Standard Specifications-State of California) shall not be less than 95%. Trenches outside the roadway shall be compacted to not less than 90%.
- All material testing, including relative compaction may be performed by a registered engineer specializing in material testing. This Department reserves the right to require additional tests at locations and depths designated during performance of the work. All material testing shall be at the permittee’s expense. The County of Monterey shall be the sole judge as to the adequacy of all tests and test results and shall receive a copy of all test results within seven (7) working days after testing. The County reserves the right to require Certificates of Compliance and other test reports.
- Trench restoration requirements shall consist of:
(a) Structure Backfill, minimum thickness of twenty-two (22”) inches (R-60, SE-25, C-95%)
(b) Class 2 Aggregate Base, minimum thickness six (6”) inches (R-78, SE-27,RC-95%)
(c) Liquid Asphalt – Prime Coat – minimum 0.20 gal/sq yd.
(d) Type B asphalt concrete, minimum thickness three (3”) inches or match existing or better.
(e) Asphalt emulsion – paint binder.
However, in areas where existing base and surfacing exceed the minimum specified thickness, replacement shall equal existing structural section.
The above shall be considered the minimum requirements allowed and are not intended to restrict the permittee from increasing the structural section as may be deemed necessary.
In the event the requirements contained in the Specifications and Plans submitted by the permittee exceed those specified above, the permittee’s requirements shall prevail.
- Where one-half (1/2) of a traffic lane, or more than one-half (1/2) the roadway is disturbed, damaged or undermined, the entire lane or roadway shall be reconstructed in accordance with Paragraph (14).
- Before permanent pavement is placed, the edges of the trench shall be cut to a straight line with vertical sides and treated with paint binder. Paving is to be finished to a true and even plane with the adjacent pavement. In addition to asphalt paving, on chip seal finish roads, a medium type chip seal shall be required and shall be applied in accordance with Section 37 of the Caltrans Standard Specifications latest edition.
- The Monterey County Road Commissioner shall be the sole judge as to the adequacy of the finished pavement within the area of responsibility of the County of Monterey.
- If the trench is located within three (3’) feet outside of the edge of pavement, the trench and the shoulder between the trench and edge of pavement shall be regarded and restored with a minimum of four (4”) inches of Class 4 Aggregate Base and to the grade of the original shoulder.
- Upon completion of the work, the disturbed portion of the roadway shall be finished in accordance with Section 22 of the Standard Specifications – State of California. Surplus material shall be removed and disposed of and the streets restored to a safe, neat condition. Grass, ice plant and shrubbery in areas supporting such vegetation disturbed by this work shall be replaced and restored in kind. Dust control shall be in accordance with Section 10 of the State Standard Specifications.
- The permittee agrees that upon final acceptance of the work within the County of Monterey right-of-way, the permittee will repair, at his sole expense, any trench settlement, erosion, cracking, or failure which occurs any time during the one (1) year period subsequent to the date of final acceptance. Should the permittee, within a reasonable time after demand fail to make any and all such repair or replacements, the County of Monterey will undertake said repairs and replacements and the permittee shall reimburse the County of Monterey for any and all costs of said repair or replacement including overhead and engineering costs. Permittee may be required at the time of final acceptance to file with the County of Monterey, a corporate surety bond to insure the requirements of this paragraph will be complied with.
- Reference is made to Monterey County Code, Title 14.04.150. In the event the future improvement of the highway necessitates the relocation of this encroachment, the permittee will relocate the same at his sole expense.
- A permit may be required by the Coastal Development Act of 1976.
- The permittee shall indemnify and save harmless the County of Monterey and all its officers, agents and employees thereof, from all claims, suits, or actions of any name, kind, and description brought forth and resulting directly or indirectly in connection with this encroachment permit.

To Whom it May Concern:
Please find attached drawings outlining details for installing various utility structures within County right-of-ways in accordance with Department of Public Works Policy.
Be advised, however, that these drawings shall not supersede details shown on Subdivision Plans, included in Encroachment Permits or specific instructions found necessary by this Department in unusual circumstances. They also shall not relieve a utility company of the responsibility of locating utility poles in locations that will not constitute a hazard to public traffic.

The following conditions shall be considered as a part of the Encroachment Permit.
All permit work shall conform to the current Standard Details and Specifications of the County of Monterey and the State of California Standard Specifications. A copy of this permit must be kept on the work site at all times and shall be exhibited upon demand by representatives of Public Works, the Fire Department, Police Department, and the Highway Patrol.
The Permittee shall give not less than forty-eight (48) hours notice of intent to work, exclusive of Saturdays, Sundays and Holidays.
Note: No Permit Shall Be Construed As Authority To Close A Road.
Surplus materials shall be removed and disposed of and the work site left in a neat and professional manner.
All Encroachment work must be adequately posted, signed, barricaded and lighted by the permittee.
Traffic signs and contractor warning devices shall be in accordance with the “Manual of Warning Signs, Lights and Devices for Use in Performance of Work upon Highways” issued by the State of California, Business and Transportation Agency, Department of Public Works.
Gradient area in back of curb to back of sidewalk shall be graded at plus two percent (+2%) from top of curb.
Permittee shall remove, replace, grade and compact minimum six inches (6”) of Class 2 Aggregate Base and three inches (3”) minimum of Type B Asphalt Concrete, one foot (1’) minimum from edge of pavement to the new work.
Existing drainage shall be undisturbed or improved. Portland Cement Concrete for concrete curb, gutter, sidewalk and drive approaches, including repair work, shall consist of five (5) sacks Type 2 Class B Portland Cement Concrete, unless otherwise specified.
Construct a ________foot Portland Cement Concrete approach to meet sidewalk grade.
A minimum of two inches (2”) of compacted sand shall be placed under all new concrete work with a 4” P.C.C. (min) for sidewalks and curb return.
Existing curb shall be saw cut according to the requirements of the Standard Specifications.
